TITLE OF BILL:
An act to amend the public health law, in relation to requiring children
to receive booster immunizations for diphtheria and tetanus and an acel-
lular pertussis vaccine
 
 
PURPOSE:
To require the administration of any booster immunizations for diphthe-
ria, tetanus toxoids and an acellular pertussis to children born on or
after January 1, 1994 and entering sixth grade or a comparable level
special education program on or after September 1, 2007.
 
 
SUMMARY OF PROVISIONS:
The bill would add a new paragraph to subdivision 2 of section 264 of
the public health law to require the administration of any booster
immunizations for diphtheria, tetanus toxoids and an acellular pertussis
to children born on or after January 1, 1994 and entering sixth grade or
a comparable level special education program on or after September 1,
2007.
 
 
JUSTIFICATION:
Between 2000 and 2005, over 4500 cases of pertussis were reported in New
York State. Nationwide, in 2003 the number of reported cases of pertus-
sis increased to 11,647. Some 39 percent were adolescents age 10-19.
Between 1980-2002 there was a 5.6-fold increase in reported incidence
even though immunization rates were unchanged. The US Centers for
Disease Control and Prevention reported that from 1994 to 1996, the
average incidence of pertussis in adolescents aged 10-19 increased by
106 percent compared with the incidence in 1990-1992. Fully 25 percent
of prolonged cough illness in adolescents and adults is pertussis
disease. It is estimated that 12 percent of cases are actually reported
nationwide. Immunity from childhood vaccination generally wears off
after five to 10 years leaving many teens susceptible to this serious
and highly contagious disease. Adolescent vaccination has the potential
to reduce the burden of disease in the targeted age group and possibly
also reduce transmission of pertussis in the community, providing indi-
rect protection to un-immunized infants. Vaccination of adolescents is
likely to be effective and beneficial. A cost-benefit analysis for the
use of a pertussis booster vaccine in adolescents and adults projected
that vaccination of all people in the U.S.  10-19 years of age or older
during a 10-year period could prevent up to 1.8 million cases of pertus-
sis and save up to $1.6 billion in direct and indirect costs.

                                  CHAPTER 506
 
   AN ACT to amend the public health law, in relation to requiring children
     to  receive  booster  immunizations  for diphtheria and tetanus and an
     acellular pertussis vaccine
 
       Became a law August 16, 2006, with the approval of the Governor.
            Passed by a majority vote, three-fifths being present.
 
     The People of the State of New York, represented in Senate and  Assem-
   bly, do enact as follows:
 
     Section  1. Subdivision 2 of section 2164 of the public health law, as
   amended by chapter 207 of the laws  of  2004,  is  amended  to  read  as
   follows:
     2. a. Every person in parental relation to a child in this state shall
   have administered to such child an adequate dose or doses of an immuniz-
   ing  agent  against  poliomyelitis, mumps, measles, diphtheria, rubella,
   varicella, Haemophilus influenzae type b (Hib), pertussis, tetanus,  and
   hepatitis  B,  which  meets  the standards approved by the United States
   public health  service  for  such  biological  products,  and  which  is
   approved  by the department under such conditions as may be specified by
   the public health council.
     b. Every person in parental relation to a child in this state born  on
   or  after January first, nineteen hundred ninety-four and entering sixth
   grade or a comparable age level special education program with an  unas-
   signed grade on or after September first, two thousand seven, shall have
   administered  to such child a booster immunization containing diphtheria
   and tetanus toxoids, and an acellular pertussis vaccine, which meets the
   standards approved by the United States public health service  for  such
   biological  products, and which is approved by the department under such
   conditions as may be specified by the public health council.
     ยง 2. This act shall take effect September 1, 2007.
